Welcome to Hockey512 ("Hockey 512," "we," "our," or "us"). By accessing or using hockey512.com (the "Site") and any related services, dashboards, APIs, data feeds, or downloadable content (collectively, the "Services"), you agree to these Terms and Conditions (the "Terms"). If you do not agree, do not use the Services.
The Services provide statistical analysis, forecasting, historical information, and related tools for NHL hockey. The information is provided for informational and educational purposes only and does not constitute legal, financial, or professional advice. You are solely responsible for ensuring that your use of the Services complies with all applicable laws and regulations in your jurisdiction.
We offer paid subscriptions that grant access to features and data within the Services. Current plans include:
By starting a subscription, you authorize us (and our payment processor) to charge the applicable fees to your payment method. Subscriptions automatically renew at the end of each billing period unless you cancel before renewal. Cancellation is self-service and one click in your user profile’s subscription settings; when you cancel, access continues through the end of the current paid term.
No refunds. All sales are final. We do not offer refunds or credits for partial periods, downgrades, or unused Services, except where required by law. Your statutory rights are not affected.
Subscriptions grant access to our historical archive and current data while your subscription is active. We may limit bulk downloading, exporting, or automated access to protect our systems and intellectual property.
During an active subscription, Hockey 512 grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and view the data and analyses for your personal, non-commercial use. You may not resell, redistribute, sublicense, publish, or make the data or analyses available to third parties, whether for free or for a fee, without our prior written consent.
NHL team names, logos, marks, and other league intellectual property are the property of the National Hockey League, NHL teams, and/or their respective owners. Hockey 512 is not affiliated with, endorsed by, or sponsored by the NHL or its teams. Any such names or logos appearing in the Services are used for descriptive and informational purposes only.
The Services display information derived from NHL game data and other publicly available sources. All models, forecasts, statistical analyses, algorithms, software, site design, and original content (collectively, "Hockey 512 IP") are owned by Hockey 512 and protected by intellectual property laws. You may not copy, reproduce, modify, distribute, adapt, reverse engineer, or create derivative works of Hockey 512 IP without our express written permission.
You agree not to use any manual or automated means to access, acquire, copy, or monitor any portion of the Services or Hockey 512 IP for the purpose of building or improving a competing product or service or for any unauthorized commercial use.
Access to some features depends on third-party or upstream data sources (including NHL APIs and feeds). If such sources are delayed, changed, limited, or unavailable, features may be disrupted, degraded, or unavailable. No uptime guarantee is provided. We may modify, suspend, or discontinue any part of the Services at any time. Your subscription provides access to historical and current data during your paid term, subject to these limitations.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized access or suspected breach.
We may suspend or terminate your account or access to the Services at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent, abusive, or unlawful activity, or if your use poses a risk to us, our users, our partners, or our systems. Upon termination, your license to use the Services and access data immediately ends. Sections intended to survive termination (including ownership, disclaimers, limitations of liability, indemnity, and governing law) will continue to apply.
THE SERVICES AND ALL CONTENT (INCLUDING DATA, FORECASTS, ANALYSES, AND SOFTWARE) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, HOCKEY 512 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to defend, indemnify, and hold harmless Hockey 512 from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
We may update or modify the Services and these Terms at any time. Changes are effective when posted on the Site. Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the United States of America and, to the extent applicable, the laws of the state or jurisdiction in which Hockey 512 is organized, without regard to conflict of laws principles. Venue for any dispute shall lie in courts of competent jurisdiction in that location. You and Hockey 512 waive any objection to such venue, including forum non conveniens.
